L4677 NOTICE OF FORECLOSURE Default having been made in the payment of the indebtedness secured by that certain mortgage dated August 28, 2006, executed by James Thomas Whitmer and Constance Ann Whitmer, a married couple, to CitiFinancial Corporation, LLC, which mortgage was recorded on August 29, 2006, in Mortgage Book 3369, Page 627, of the mortgage records in the Office of the Judge of Probate of Lee County, Alabama, which mortgage was, duly transferred and assigned to Wilmington Savings Fund Society, FSB, d/b/a Christiana Trust as Trustee for PNPMS Trust II, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the 9th Street entrance to the Lee County Courthouse at Opelika, Alabama, during the legal hours of sale on February 8, 2022, the following described real estate, situated in Lee County, Alabama, to-wit: A tract of land shown as tract 5 on a survey for Nina P. Whitmer Estates, said survey by Michael J. Pattillo, A.R.L.S. Number 16684, and being more particularly described as follows: Beginning at the Southeast Corner of Section 4, Township 17 North, Range 29 East, Lee County, Alabama, run thence South 88 degrees 35 minutes West a distance of 398.2 feet to an iron pin; Run thence South 88 degrees 08 minutes 04 seconds West a distance of 508.23 feet to the iron at the Point of Beginning of the tract herein described; Continue thence South 88 degrees 08 minutes 04 seconds West a distance of 796.61 feet to an iron pin on the Easterly Right-of-Way of Hill Driver; Run thence North 02 degrees 30 minutes 11 seconds West along said Right-of-Way a distance of 496.65 feet to an iron pin; Run thence North 87 degrees 29 minutes 49 seconds East a distance of 807.05 feet to an iron pin; Run thence South 01 degrees 18 minutes 49 seconds East a distance of 505.62 feet to the iron pin at the Point of Beginning. Said Tract contains 9.22 acres, more or less, and is situated, lying and being in Section 4, Township 17 North, Range 29 East, Lee County, Alabama. Subject to all restrictions, reservations, rights easements, Rights-of-Way, provisions, covenants, terms, conditions and building set back lines of record. This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an "as is, where is" basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
